Mr. Cummiskey’s practice is a blend of litigation and general counsel work for corporations, non-profits, small businesses and individual clients. In his role as a litigator his expertise focuses on the defense of employment claims (discrimination, wage and hour, wrongful termination and PAGA), business disputes, general liability and real estate matters.
In Mr. Cummiskey’s role as general counsel for businesses and non-profits he routinely negotiates and drafts agreements (employment, corporate governance, entity formation, purchase, sale and restructuring) and advises boards of directors and senior management on issues of statutory change, regulatory compliance and employment concerns (hiring, retention, termination and wage and hour). Mr. Cummiskey also advises human resource directors on updates to the labor code and policy and procedure manuals.
Mr. Cummiskey graduated from Ithaca College in Ithaca, NY with a B.S. in Sports Therapy. He then enlisted in the US Army, eventually obtaining the rank of Sergeant while serving out of Ft. Bragg, North Carolina. Mr. Cummiskey attended Syracuse University School of Law, eventually clerking for the Honorable Norman H. Mordue, of the U.S. District Court, Northern District of New York. Mr. Cummiskey has traveled extensively and these life experiences have proven invaluable in his practice today.
