This was a major injury case involving a Plaintiff who suffered severe injuries after being struck by debris due to an explosion at the MillerCoors brewing facility in Irwindale, California. Among other injuries, the explosion caused Plaintiff significant eye damage and potential vision loss.
As a result of the explosion, Plaintiff filed a Complaint against a number of defendants, including our client, who was involved in the supply of component parts to MillerCoors. Plaintiff alleged, in part, that the parts supplied by our client were defective and caused the explosion, directly leading to his severe injuries.
After months of litigation and discovery, our team developed evidence that the component parts supplied by our client could not have been the cause of the explosion. Despite resistance and alternative theories from other parties in the case, our team leveraged early accident reconstruction analysis to push for a dismissal. Ultimately, in order to avoid reimbursing our client for fees and costs incurred in defending the lawsuit and facing potential summary judgment, Plaintiff dismissed their Complaint against our client.
This is a tremendous result given the catastrophic nature of the subject incident and Plaintiff’s multi-million dollar claim. The early dismissal from the claim due to aggressive discovery, expert and investigative work saved the client thousands of dollars in additional attorney fees.
