Bremer Whyte Brown & O’Meara is proud to announce that Newport Beach Partner Morgan Stiefel and Associate Kevin Moore obtained a great verdict after years-long litigation in favor of their client.
This lawsuit stemmed from a claim made by Plaintiff for injuries arising out of a negligence claim due to BWB&O’s client rolling her vehicle’s tire into the back of Plaintiff’s left ankle. Plaintiff alleged that he developed right knee pain a year after the accident because of a compensatory injury.
While BWB&O’s team accepted liability for the ankle injury, they argued that Plaintiff’s right knee pain and injury could not have been caused by their client. Through expert testimony and persuasive arguments, BWB&O demonstrated to the jury that the Plaintiff’s right knee injury was caused by alternative factors, including a lifetime of basketball and an active lifestyle prior to the incident.
Plaintiff’s demand the week before the trial was $499,000. The night before the trial, they increased the demand to $2.2 million. Plaintiff then asked the jury for $7.7 million during the trial. The jury returned a verdict of $300,000 for the ankle injury and $0 for the knee injury. This was a massive win for BWB&O and its client, as the award fell within the insurance policy limit.
