Allocation of Responsibility in Construction Claims: Sometimes the responsibility for a construction claim is straightforward and there is no question about who or what is responsible; for instance, which trade is responsible for a leaking roof or window? Often there is a question and if there is, we have a process for analyzing the claim, figuring out who should be involved, allocating responsibility, and packaging claims against the responsible parties. The analysis often includes a combination of indisputable “science” and the “art” of applying professional judgment or expert opinions.
