The case involved claims for unlawful interference with a contract for attorney’s fees and defamation. The plaintiff, a law firm based in San Diego, California, alleged that BWB&O’s client intentionally interfered with the law firm’s fee agreement with its clients, and that BWB&O’s client defamed the law firm in the process. The plaintiff law firm filed a lawsuit against BWB&O’s client in the United States District Court, Southern District of California, seeking $5,000,000 in alleged lost attorney’s fees as damages.
Ms. Whyte, Mr. Price, and Ms. Serrato filed a motion for summary judgment, asking the Court to enter Judgment in favor of BWB&O’s client as to all claims as the alleged conduct came within the litigation privilege. The Court agreed with them, granted the motion in its entirety, awarded the plaintiff law firm nothing, and entered Judgment in BWB&O’s client’s favor, all without proceeding to trial.
