Congratulations to Partner Alison Hurley and Associate Michelle Le for securing a complete defense following a four-week jury trial in San Bernardino.
Plaintiff was a passenger in our client’s van when it was hit by a tractor-trailer. As a result of the collision, Plaintiff claimed he suffered a serious and degenerating eye injury leaving him functionally blind in his left eye. Plaintiff aggressively pursued recovery against Bremer Whyte’s clients during trial, devoting the majority of his case in chief establishing fault against the van’s driver and owner, rather than against the tractor-trailer driver. Plaintiff asked the jury to award him more than $2.2 million in total damages at the close of trial.
After deliberating for more than three days, the jury returned a verdict assessing 0% fault to Bremer Whyte’s clients and 100% fault to the tractor-trailer driver. The jury also awarded less than 10% of the sum Plaintiff prayed for in closing, returning a verdict of just $200,000.00 against the other Defendant.
