Bremer Whyte Brown & O’Meara, LLP Newport Beach Partner Kendra Arnold and Associate Melani Bartholomew obtained a significant litigation victory on behalf of a Southern California restaurant operator in a civil action involving allegations of employee misconduct. The Court granted summary adjudication in favor of the firm’s client on three of the four causes of action asserted against it, including sexual assault and battery, negligence, and violation of the Tom Bane Civil Rights Act.
The ruling followed the Court’s determination that the alleged employee misconduct was not sufficiently related to the client’s business to impose vicarious liability. The ruling eliminated all claims against the client seeking punitive damages, substantially narrowing the case and eliminating its punitive damages exposure.
Congratulations to Kendra and Melani on this outstanding result and their continued dedication to achieving favorable outcomes for our clients!
