It was alleged that the decedent passed away due to the use of a new dietary ingredient often utilized for energy purposes. However, through targeted discovery, including the deposition of the decedent’s spouse, Jeff and Shanna developed compelling evidence that the product at issue was most likely purchased from a co-defendant, not their client.
Moreover, based on the toxicology and autopsy findings, they argued that even if the product had been purchased from their client, the decedent suffered from comorbidities and/or failed to utilize the product in accordance with the manufacturer’s recommendations, which either individually or collectively caused and/or contributed to the decedent’s passing.
Jeff and Shanna took an aggressive position on liability and damages from the outset of the litigation and remained steadfast in their defense, resulting in an excellent outcome for their client.
