BWB&O’s Reno Partner Karen Baytosh recently obtained an Order granting a Motion for Summary Judgment in construction defect litigation against the General Contractor client who oversaw the installation of underground storage tanks at a new gas station. After one of the tanks leaked, the owner sued the general contractor, the subcontractor, the manufacturer, and its insurance carrier. The Court agreed with the general contractor and subcontractor that the designated experts failed to prove the leak was caused by improper installation. Following the trial against the insurance carrier last week, the jury agreed with the Court finding that the leak was not caused by installation of the tank.
