Environmental Litigation & Toxic Torts

Bremer Whyte has extensive, broad-based experience representing businesses, corporations, individuals and insurance companies facing liability and mass toxic tort cases and actions stemming from environmental law, toxic substances and habitational statute violation claims and litigation.

What are Toxic Torts?

A toxic tort claim occurs when a plaintiff alleges that they have been exposed to chemicals or other dangerous substances that result in personal injury, disease or wrongful death. These types of claims or lawsuits can result from new materials used in technology, manufacturing and medicine. Other examples include hazardous material leaking into the air, ground or bodies of water.

Where Do Toxic Tort Claims Usually Arise?

Claims for toxic torts are often in the form of class action lawsuits. This is when the plaintiff party involved is a group rather than an individual. Toxic tort claims are often seen in the following:

  • Occupational exposure – this occurs when construction or industrial workers are exposed to hazardous materials. Exposure of toxic chemicals at high levels for a short period of time or low levels for an extended period of time can both be detrimental to one’s health. One example of this includes worker’s exposure to asbestos on a job site.
  • Pharmaceutical drugs – the unintended side-effects of pharmacy grade drugs can fall into the category of toxic tort.
  • Consumer product liability – Individuals who become ill or develop a life changing condition from household products like pesticides or paint. Foods that may have been contaminated prior to sale can also be considered toxic tort in some circumstances.

Dedicated Toxic Tort Litigators

Our toxic tort lawyers represent clients in cases ranging from personal injury claims from toxic substances like benzene, beryllium, manganese, silica, lead-based paints and asbestos exposure, to toxic mold claims and landlord habitation statute violations. Some of the life-threatening diseases that result from exposure to these toxic materials include, but are not limited to:

  • Aplastic anemia
  • Asbestosis
  • Hodgkin’s Disease
  • Lung Disease
  • Leukemia
  • Mesothelioma
  • Silicosis

These complex class-action lawsuits overlap with areas of liability including extensive personal injuries, property damages and economic losses, as well as possible massive statutory-based penalties.
