Newport Beach Team Successfully Defends Their Client in a Dog Bite Case

Bremer Whyte Brown & O’Meara, LLP is proud to announce Partner Arash Arabi and Associate Morgan Piercy victoriously defended their client in a dog bite/premises liability matter, resulting in a successful Motion for Summary Judgment in Orange County Superior Court!

BWB&O’s client was the homeowner and landlord, who was unaware of the tenant’s dog residing or being present at the property at any time. The Plaintiff was unable to provide any proof that BWB&O’s client had actual knowledge or constructive notice of the existence of the animal. Ultimately, the Court sided with BWB&O’s client, finding that a landlord cannot be liable for injuries that occur on his or her property if he or she has no knowledge, nor could they have had such knowledge, that a dangerous condition existed at or prior to the injury.
