BWB&O’s client was the homeowner and landlord, who was unaware of the tenant’s dog residing or being present at the property at any time. The Plaintiff was unable to provide any proof that BWB&O’s client had actual knowledge or constructive notice of the existence of the animal. Ultimately, the Court sided with BWB&O’s client, finding that a landlord cannot be liable for injuries that occur on his or her property if he or she has no knowledge, nor could they have had such knowledge, that a dangerous condition existed at or prior to the injury.
