After relentless effort, Partner Rick Peterson and Associate Lindsey Wells secured a complete defense verdict in favor of our clients, who own and operate various businesses in Newport Beach, California, ultimately defeating 12 causes of action brought by Plaintiff.

Plaintiff, who was a guest at a hotel owned and operated by the Defendants, alleged several claims related to her stay, including Breach of Warranty of Habitability, Private Nuisance, Negligence, Violations of the Americans with Disabilities Act, and Violations of the California Business and Professions Code. Through numerous strategic Pre-Trial Motions, BWB&O was able to reduce Plaintiff’s claims from 12 to eight before trial.

During the trial, Plaintiff rested her case, and BWB&O moved for a directed verdict, successfully defeating several of Plaintiff’s claims in their entirety. During Defendants’ case-in-chief, BWB&O successfully exposed Plaintiff’s lack of evidence and credibility through effective cross-examination and testimony from several key witnesses. After closing arguments, the Court found that Plaintiff failed to prove any of her claims and that her testimony lacked credibility, thereby favoring the Defendants.
