Encinitas Partner Tim McNulty successfully prevailed on a Motion for Summary Judgment in San Diego Superior Court obtaining a judgment of $202,224.28 in favor of our shopping center client against a commercial tenant who refused to pay rent for two years and vacate the leased premises. The tenants’ attorney asserted various defenses related to Covid-19 restrictions and failure to mitigate which were rejected by the court.
The Summary Judgment order also contains the right to recover attorney’s fees and costs in favor of the client.
Mr. McNulty also successfully handled the prior Unlawful Detainer case obtaining possession of the same premises by an eviction conducted by the San Diego County Sheriff.
