Bremer Whyte Brown & O’Meara, LLP’s Colorado Partner Devin Brunson, and Senior Associate Doug Baier recently received a tremendous defense verdict after a five-day jury trial.
Plaintiff was involved in three auto losses in this suit alone that resulted in almost $300,000 in past medical expenses for alleged injuries to his spine and knee, as well as a traumatic brain injury. Prior to trial, Plaintiff settled with the two other Defendants and attempted to apportion 70% to BWB&O’s clients. Plaintiff claimed the need for future medical care/surgeries, permanent impairment, as well as past and future wages. In all, Plaintiff sought damages of more than $2,500,000 against BWB&O’s clients alone.
BWB&O presented its side to the jury who found Plaintiff was comparatively at fault for the rear-end accident and his claims for future medical expenses, permanency, and future wage loss were not entirely credible. The jury ultimately only awarded Plaintiff less than 20% of his claimed damages, which resulted in a verdict of just over $400,000.
